Terms of Service

These Terms of Service ("Terms") govern your access to and use of Almost Heaven Expeditions (the "Service"). By creating an account, purchasing a trail, or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Accounts

You must provide accurate information and keep your account secure. You are responsible for all activity under your account. You must be at least 18 years old, or the age of majority where you live, to make a purchase.

2. What you're buying

Trails are digital products consisting of GPX files and related content. A purchase grants you a personal, non-exclusive, non-transferable, revocable license to download and use the trail's files for your own recreational off-road and overland navigation. Your purchase includes lifetime access to that trail and to future updates we publish for it, for as long as the Service is available.

3. Acceptable use

You may not resell, sublicense, redistribute, publicly post, or commercially exploit the GPX files or the precise route data; reverse engineer or scrape the Service; share your account or downloads with others; or use the Service unlawfully. We may suspend or terminate accounts that violate these Terms.

4. Pricing and payment

Prices are shown at checkout and may include a service fee that covers payment processing and platform costs. Payments are processed by Stripe; by purchasing, you also agree to Stripe's terms. We may change prices at any time, but changes won't affect trails you already own.

5. Refunds

Because trails are delivered digitally and immediately, sales are generally final. See our Refund Policy for when we will make exceptions.

6. Guide content and intellectual property

Trails are created by independent guides who retain ownership of their content and grant us the right to host and sell it. The Almost Heaven Expeditions name, branding, and the Service's software are owned by us and may not be used without permission.

7. Ride at your own risk

Off-road and overland travel is inherently dangerous. Trails are provided for navigation reference only and may be inaccurate or out of date. Trail conditions, access, and land status change. You are solely responsible for your safety, your vehicle, confirming legal and permitted access, and obeying all laws, closures, and private-property boundaries. The Service and its content are provided "as is" and "as available," without warranties of any kind.

8. Limitation of liability

To the fullest extent permitted by law, Almost Heaven Expeditions and its guides and operators will not be liable for any indirect, incidental, special, or consequential damages, or for any injury, loss, or damage arising from your use of the Service or any trail. Our total liability for any claim will not exceed the amount you paid for the trail at issue.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms. Sections that by their nature should survive termination will survive.

10. Changes

We may update these Terms from time to time. Material changes will be posted here with an updated date; continued use means you accept the revised Terms.
